📄 SBX Performance Terms & Conditions Agreement

By checking the box during checkout and submitting an order, you acknowledge and agree to the following:

⚠️ Legal Use and Compliance

  • I understand that some products sold by SBX Performance are designed for off-road or racing use only, and may not be legal for use on public roads or highways.

  • I accept full responsibility for ensuring that any products purchased comply with local, state, and federal laws, including emissions regulations.

  • I understand that SBX Performance is not responsible for my misuse or misapplication of any product, or for ensuring its compliance with any vehicle safety or emissions standards.

⚖️ California Proposition 65 and Emissions Compliance

  • I acknowledge that some products may include Proposition 65 warnings for California residents and may contain chemicals known to cause cancer, birth defects, or other reproductive harm.

  • I understand that products not CARB-certified are not legal for use on pollution-controlled vehicles in California and are intended strictly for race/off-road use only.

  • By placing an order, I agree to assume all legal responsibility for how and where these products are used.

💸 Tariffs, Customs Duties, and Import Fees

  • I understand that SBX Performance is not responsible for any import duties, VAT, tariffs, customs fees, or clearance charges imposed by my local government.

  • These charges, if applicable, are the sole responsibility of the customer, and refusal to pay them may result in package abandonment without refund.

  • (Funk Motorsport, Airtec, and Infinity Design products ship direct from the UK and may incur duties.)

🧾 Order Accuracy & Special Orders

  • I acknowledge that it is my responsibility to ensure that all information provided in the order is correct.

  • I understand that products labeled as "Special Order" or "Made-to-Order" are custom-manufactured specifically for me and are non-refundable and non-cancellable once confirmed.

🔁 Return & Refund Policy

  • Standard Return Window: We accept returns within 30 days of the original delivery date, except for items marked as Special Order or Made-to-Order, which are final sale.

  • Condition Requirements: Returned items must be unused, in brand new condition, and in their original packaging with all hardware and documentation included.

  • Restocking Fee: Returned items are subject to a restocking fee of up to 20%, depending on the item and condition.

  • Non-Returnable Items: Special Order, Made-to-Order, and used, installed, or modified products are not eligible for return.

  • Return Shipping: Customers are responsible for return shipping costs unless the return is due to our error or a defective product.

To initiate a return, please contact sales@sbxperformance.com for an RMA (Return Merchandise Authorization) and instructions. Returns without prior approval may be refused.

Pricing & Order Policy

1. Pricing Accuracy

We make every effort to ensure the accuracy of all prices and product information listed on our website. However, errors may occasionally occur. If an item is listed at an incorrect price due to a typographical error, technical issue, or mistake in supplier information, we reserve the right to refuse or cancel any orders placed for that item.

2. Order Acceptance

All orders placed through our website are considered offers to purchase. An order is not considered accepted until we have processed payment, confirmed the order, and shipped the item(s). If an order is canceled due to a pricing error, you will be notified promptly and issued a full refund.

3. Right to Cancel

We reserve the right to cancel any order, in whole or in part, that is affected by an error in pricing, product availability, or other unforeseen circumstances. If your order is canceled, you will receive a full refund for the canceled item(s), and we will notify you immediately.

4. Product Availability

Occasionally, a product may become unavailable after an order has been placed. In such cases, we will notify you as soon as possible and issue a full refund for the unavailable item(s).

5. Customer Satisfaction

We understand errors can be frustrating, and we strive to resolve them quickly and fairly. If your order is affected by a pricing or availability issue, our customer support team will work with you to find a suitable solution, which may include offering the item at the correct price or suggesting alternative products.
